Common Accident & Injury Questions

What if the other driver does not have insurance?
If the other party is at fault and does not have insurance or enough insurance to cover your claims then you will need to review all other potential sources or recovery; your auto policy, the other party’s home policy, or the other party’s bank account or assets. You should not settle with the other drivers insurance company or your insurance company prior to our lawyers reviewing your claim.  You may be entitled a larger settlement.

Can a passenger file a claim against either driver?
An injured passenger in an auto accident has the legal right to file a claim against the at fault driver.  Whether the at fault driver is the driver of the vehicle the injured client was  riding in or the at fault driver was the driver of the other vehicle.

Will my health insurance pay for my medical treatment?
Yes. Your rights to recover damages incurred in a car accident that was the fault of another is not affected by any payments made by your health insurance. Depending upon the terms of your health insurance plan, the payments made by your insurance company may be subject to reimbursement in the event of a recovery against the party at fault.

What compensation am I entitled to?

What is the time limit for filing a claim?
There is no set time limit to in filing a claim with the insurance carrier, but there is typically a two year statute of limitations to file a lawsuit.  The two year  time limit is crucial because if the carrier denies liability then your remedy for reimbursement is to file a lawsuit.  If two years has passed since the accident then you are prevented from filing a lawsuit.

Can I sue my employer for a work injury? In Nevada, workers compensation coverage limits the ability to sue your employer.  Workers comp coverage provides for reimbursement of medical bills, lost wages, future medical and disability compensation.   If your employer is found to be negligent then you may be able to sue for additional benefits.

What is Temporary Partial Disability (TPD)?
TPD are benefits paid under workers comp coverage. The benefits that are paid to ensure that the injured worker never receives less than his compensation rate while working a light duty position.
